Conditions of participation

Participation in the above-mentioned competition is subject to the following conditions of participation.

1. General conditions of participation

1.1 The competition "Career Service Survey" (hereinafter referred to as "Competition") is organized by the Karlsruhe Institute of Technology, Kaiserstraße 12, 76135 Karlsruhe (hereinafter referred to as "KIT").
1.2 Participation in the sweepstake is free of charge.
1.3 Participation in the contest is possible online during the survey period: May 4, 2020 - June 20, 2020 and ends on June 20, 2020 at 12:00 p.m. (hereinafter referred to as "participation period").
1.4 No winner data will be published.

2. Eligibility to participate

2.1 All natural persons who are enrolled as students at KIT at the time of participation and have a KIT e-mail address are eligible to participate.
2.2 Only one participation in one's own name is possible per participant. Multiple participations are not permitted.
2.3 Minors (under 18 years of age) require the consent of their legal guardians for participation in the contest and for all legal declarations associated with participation.
2.4 To participate in the Contest, the KIT e-mail address must be entered in the survey during the participation period.
2.5 Survey entries submitted outside the participation period will not be considered. The organizer is not responsible for any delays in sending the survey.
2.6 By entering the KIT e-mail address, the participant expressly accepts these Terms of Participation.

3. Exclusion from the contest

3.1 KIT employees and their relatives are excluded from the contest.
3.2 The organizer reserves the right to exclude participants from the competition and not to distribute prizes or to subsequently withdraw them if these conditions of participation are violated.

4. Prize, determination of the winners

4.1 20 KIT first semester backpacks will be raffled among all participants.
4.2 The winners will be determined by lot after the end of the promotion period. Only one entry per participant* will be considered.
4.3 Cash payment, change or exchange of the prize is not possible.
4.5 Participation in this contest does not oblige to register for KIT newsletters or other KIT communication media.
4.6 Registration for KIT newsletters or other KIT communication media does not affect the possibility of winning and therefore does not increase the chances of winning.

5. Notification of winners / provision of prize

5.1 The winner will be notified by e-mail at the end of the promotion period.
5.2 Winners must make a personal appointment with the KIT Career Service by June 30, 2020 to receive their prize. The winner is responsible for the correctness of the data he/she has submitted to the organizer.
5.3 The claim to the prize will be forfeited if the winner does not collect the prize within the aforementioned period; another participant will then be drawn.

6. Liability, cancellation of the competition

6.1 KIT is liable within the scope of the legal provisions only for material and financial damages caused by intent and gross negligence.
6.2 In case of violation of essential contractual obligations KIT is liable for intent and negligence. In case of simple negligence, liability is limited to foreseeable, contract-typical, and direct damages. Essential contractual obligations are those obligations that protect the legal positions of the contracting parties that are essential to the contract and that are to be granted to them according to the content and purpose of the contract. Furthermore, essential contractual obligations are those contractual obligations whose fulfilment makes the proper execution of the contract possible at all and on whose compliance the contractual partner could regularly rely.
6.3 The limitations / exclusions of liability shall not apply to claims under the Product Liability Act, for fraudulent conduct, from liability for guaranteed characteristics and from injury to life, body or health.
6.4 The Organiser reserves the right to interrupt, modify or completely cancel the competition at any time for good cause without prior notice. Important reasons are in particular if, for legal reasons, a proper execution of the competition cannot be guaranteed.

7. Data protection
7.1 In connection with the contest, KIT collects, uses, and stores personal data of participants exclusively in accordance with the provisions of the State Data Protection Act (LDSG) of the State of Baden-Württemberg.
7.2 By providing the required data in the survey, you agree that KIT may collect, use, disclose, transmit, and store your personal data or other information obtained by KIT as a result of such use in accordance with the provisions of the LDSG.
7.3 Personal data of all participants and winners will only be processed to the extent and as long as necessary for the execution of the contest and the handling of the prize notification and delivery, unless you have given your consent to receive the mailing. Personal data such as name, first name, address, age and/or e-mail address will be treated in accordance with legal regulations.
7.4 Further information on data processing in connection with the competition and the rights to which you are entitled can be found in the data protection declaration at https://www.kit.edu/datenschutz.php.

8. Miscellaneous

8.1 Side agreements, amendments and supplements to the participation contract including these General Terms and Conditions must be in writing. This also applies expressly to any change to the above written form requirement.
8.2 Should individual provisions of the participation contract including these General Terms and Conditions of Business be or become legally ineffective, or should loopholes arise, the validity of the remaining participation provisions shall remain unaffected.
8.3 This participation contract, its creation and execution is subject exclusively to the law of the Federal Republic of Germany. The validity of international private law and the UN Convention on Contracts for the International Sale of Goods is excluded. Mandatory provisions of the state in which the consumer has his habitual residence remain unaffected.
8.4 The place of jurisdiction for all disputes arising from the contractual relationship is Karlsruhe. Jurisdiction based on an exclusive place of jurisdiction remains unaffected. Contract language is German.
